STOP BLAMING ANIMAL RIGHTS ACTIVIST ROBYN BERKENFELD! Animal Hoarder Kimi Peck’s Attack Website from 2009

UPDATE: Kimi Peck was arrested AGAIN in 2014 and charged with animal cruelty!!!! This is Peck’s second arrest pertaining to animal related abuse in 5 years…

Why does serial animal hoarder/abuser/breeder, Kimi Peck, continue to wrongly accuse animal rights activist Robyn Berkenfeld – of rediculous false claims on NUMEROUS blogs Peck and/or one of her few unemployed/’disabled’ ‘supporters’ admin? Because Robyn Berkenfeld has exposed many of Peck’s illegal kennels and has saved hundreds of sick dogs from Peck. Though Peck claims she is a good person and never stalks or harasses people – She is wrong. Besides her many blogs, yes plural, full of lies, Peck has also posted comments on news stories exposing Peck’s animal abuse – blaming Robyn Berkenfeld for everything. Sorry Kimi Peck. All anybody has to do is google Kimi Peck and you will see reliable news stories exposing Peck’s history from 2003 to 2014. Nobody planted anything. Nobody stole records. Lt. Bruce Speirs and all of Burbank wanted Peck out of their community because she was nothing but an animal abusing nuisance. Robyn Berkenfeld was thanked by Lt. Bruce Speirs.

Kimi Peck has made over $1,000,000.00 hoarding Chihuahuas and other dogs. She is a crazy 67-year-old grandmother (estranged) and mother (estranged) with way too much time on her hands (even with hundreds of animals). Below are excerpts from Kimi Peck’s attack websites from 2009 – you can see Kimi Peck is one scary and crazy serial animal hoarder.

Peck’s ‘attack’ website from 2009 – Yes, Animal Hoarder Kimi Peck was in trouble with the law in 2009, too, but felt she was being picked on and conspired against. She’s NUTS in addition to being an animal hoarder…Who HASN’T she blamed? Herself! Here are excerpts from Peck’s 2009 website – though it looks like somebody else is writing it – it is actually Kimi Peck writing it: “In 2005 Kimi’s Burbank kennel license limit was 168 based on the square footage of the site. As the number of abandoned Chihuahuas increased and were dumped at Kimi’s gate – Kimi rented a 5000 sq. ft. warehouse next door to accommodate the exploding numbers. Trouble – backed by a deep pockets financier At about this time Robyn Berkenfeld (aka Berken) and Joan xxx were recruited and paid to launch an attack/smear campaign and character assassination scheme against Kimi Peck based on a personal vendetta – not about Chihuahuas. Lawrence J. xxx is a Pasadena attorney and husband of Joan xxx. Kimi was often outspoken about the failings of Burbank and other Animal Control authorities across Southern California. Kimi made a number of enemies in the ranks of police department officials and Animal Control public servants – especially after Kimi saved 170 Chihuahuas from the Baldwin Park, California animal shelter where the supervisor said: "Kimi Peck will get these Chihuahuas over my dead body." Lt. Bruce Spears was at the kennel every day. He had been a police officer who now was the supervisor of the Burbank animal control department. He typically had a smile for you while he stabbed you in the back. Lt. Spears told Kimi that if she built a drain in the warehouse, he would approve 200 more Chihuahuas. Kimi’s drain cost over $5,500 and was installed in the rented warehouse with the owners approval. Lt. Spears then told Kimi to waterproof the walls. Kimi’s costs for the waterproof wall treatment cost more than $3,000. Lt. Spears then said the warehouse kennel would be inspected twice a day. Suddenly Burbank City Chihuahua authorities started inspecting Kimi Peck’s kennel twice a day – and that lasted two months. Citations Petty and silly citations were given for things like a hamster that flipped over it’s water dish, an employee who carried a water dish too slowly, plastic bags filled with dog blankets that were continually washed load after load were deemed "unsanitary conditions," and then… not finding three (3) Chihuahua files designated and specifically called for out of 168 files – the only 3 that were missing that day. Those missing files were clearly a set-up by the insiders – Robyn Berkenfeld and Joan xxx. Trouble – backed by a deep pockets financier A Bizarre Police Department Probe We are informed and believe that Lt. Spears, a Burbank Police Captain and the Burbank city attorney, Greg Kaplin, were bought off. It is clear that the Burbank City Chihuahua authorities were seeking to build a case against the effective Chihuahua rescurer Kimi Peck. Kimi’s work was in the news and celebrated, she had won legal battles in court on behalf of saving the lives of Chihuahuas — all in the face of the kill policy of local government animal shelters. One late afternoon two strangers trespassed and took photos inside the kennel office. Officer Allen arrived and sometime later asked the two strangers if they had a camera. They said no. He asked if they had taken any photos on the kennel property. They said no. Officer Allen then went back to Kimi Peck to tell her that she is a liar. How do you spell "police corruption." Later, Robyn Berkenfeld and Joan xxx filed a complaint with the Burbank Police Department. After 2 months of twice a day inspections – at 10:00 AM the local tax payers paid for 10 Burbank Police Department detectives, 10 or more squad cars with 2 cops in each, code enforcement guys, and a camera team from forensics to descend upon Kimi Peck’s kennel. Little John – one of the Burbank Animal Control officers discovered a hairless Chihuahua and screamed and spit on Kimi’s face he was so close: "Get the records, Kimi. Get the records right now. Or else." Kimi called her vet and the vet records for the hairless Chihuahua’s care were instantly faxed to the kennel. Little John never apologized for his hysterical and threatening conduct in his failed attempt to show off for his superiors. Law enforcement guys and Dick Cheney don’t apologize they just say: "So"? The Burbank City Chihuahua authorities cited Kimi for having too many Chihuahuas. Kimi appeared in court on the citation for having too many Chihuahuas, despite the assurances time and again by Lt. Spears who assured Kimi could have more dogs if she just did one more thing. There is bit more to the Burbank story. Here soon ——————————————————————————– Quite an intriguing story in itself – with friends, some heroes, Chihuahua volunteers and some real dangerous, petty, vindictive, awful villains who just don’t get it but enjoy tearing down, causing unjust legal troubles, hiring hack attack attorneys, private investigators and who are just no help at all. These folks need to see the light and ought to accomplish something positive and helpful. But no. These folks are as dysfunctional as the Iraq War / Katrina inept White House guys who’s conduct we will watch all unravel in due time. ——————————————————————————– Remember – this all has to do with helping little Chihuahuas. ——————————————————————————– Trouble – backed by a deep pocket financier Some paid staff and volunteers responsible for cleaning the Burbank site complained to authorities and the press that the site was not clean. Amazing. Keeping the site clean and the Chihuahuas fed, watered and healthy was the responsibility of the staff and volunteers who instead took photos of the site early in the morning – rather than clean up, feed and water the Chihuahuas. When Kimi arrived each day, things got cracking. ——————————————————————————– A Chihuahua Sanctuary So, gone from Burbank and now in Kern County – Kimi Peck is providing a sanctuary for the Chihuahuas and other doggies that were not adopted back in Burbank along with some new little rescued friends. ——————————————————————————– Kimi would love to adopt out the 200 Chihuahuas she cares for now. But, to who? Who has the expertise to adopt a Chihuahua that has been deemed by animal control authorities as not adaptable? Well, Kimi can rehabilitate Chihuahuas as she has proven time and time again. ——————————————————————————– Kern County regulations do not allow a Chihuahua adoption business on Kimi’s property. So, it’s now just a sanctuary for "left over" Chihuahuas. ——————————————————————————– That’s the story in a nutshell. ——————————————————————————– 2008 ——————————————————————————– 2008 Trouble in Kern County – backed by a deep pockets financier Why the sudden June 2008 smear press stories? Berkenfeld & xxx back at it one more time. Kimi’s neighbor video clip on QuickTime 7 | ——————————————————————————– A Kern County neighbor is in cahoots with hired attack girl Robyn Berkenfeld from the Burbank days. ——————————————————————————– Notes: We are informed and believe: The neighbor – Barbara xxx – shoots woodpeckers. Dead. PETA and California Fish and Game ought to get in touch. Are woodpeckers on the endangered species list yet? It is likely Barbara shot at LUCY, the neighborhood Bloodhound. Her daughter, xxxx, is a methamphetamine addict who hangs out with gang guys. xxxx has three illegitimate children and has spent most of her adult life in prison. Barbara – her mom – kept a loaded shotgun in her house when SUNSHINE lived with her mother. It is unlawful for a CONVICTED FELON to have access to a gun. Barbara kept a loaded shotgun in the house with her boyfriend, also a CONVICTED FELON. He was the guy sitting next to her in City Hall recently. Either Sunshine or Barbara SHOT at Kimi Peck’s dogs two years ago. Kimi can get a copy of the written complaint document filed with the Kern County Sheriff’s Dept. Kimi Peck made a second complaint last year when LUCY, the Bloodhound was shot at. Barbara hires illegal aliens who work for her at her xxxx franchises in Tehachapi and Mojave. They typically live in her unpermitted guest house. This was reported to Code Compliance on Friday, June 20, 2008. Her xxxx have fed a lot of law enforcement officers and a local Judge at no cost. She bosts she now has an in with Sheriff deputies and that Judge. Typically these folks take her side in matters related to the law and disputes. Barbara has a number of unlawful drug habits. See DEA. Since 2005 Kimi Peck has provided Barbara with water from her well for $20 a month. Barbara thretened a legal action against Kimi Peck with respect to a written agreement about the well. Barbara’s key complaint: Kimi Peck’s dogs often bark. News Reports Kiyoshi Tomono the TV reporter may have a few follow-up questions for Barbara, if he is willing. ——————————————————————————– The painfully truth-challenged silly but dangerous attack team with ties back to Burbank who in June 2008 have launched a new PR attack against Kimi Peck, started up Internet blogs and websites, contacted the media and made reports to local Kern County authorities are clearly being financed by someone. Kimi Peck – Kiyoshi Tomono TV News Report 2 ——————————————————————————– Note: at this point we could care less about copyright to Internet video news stories. Our legal point would be that Kimi Peck is a joint author of whatever a TV station broadcasts about her and thus a joint copyright claimant and owner based on her contributions to the report. This will give you TV guys an opportunity to do some U.S. Copyright Law research. ——————————————————————————– ——————————————————————————– 2008 Trouble in Kern County – backed by a deep pockets financier We believe it is same vindictive deep pockets financier from the Burbank-Berkenfeld-xxx days – now resurfaced and with a bank account ready for trouble for Kimi Peck in Kern County. Any influence on Kern County employees? Certainly undue pressure. ——————————————————————————– That’s another story. ——————————————————————————– The goal the detractors are seeking: kill the dogs. Why? Just to kill the dogs… and to harm and injure Kimi Peck. That’s it. ——————————————————————————– Chihuahuas Instead, just seek do something good to help the previously abandoned Chihuahuas and other little sanctuary doggies that Kimi cares for. Do the right thing. That’s all we seek. ——————————————————————————– Note: It would be so nice if Kimi Peck lives through all this new turmoil and her Chihuahuas continue to have a chance at a pleasant life. ——————————————————————————– Audio Reports on rescuing dogs in Southern California”

Former Burbank Animal Control Director, Lt. Bruce Speirs ‘KIMI PECK IS GUILTY!’ and is ‘SHUT DOWN IN BURBANK’

Here are two e-mails written by former animal control head, Lt. Speirs, back in 2005, in regards to Kimi Peck’s closure. As you can see, her closure was due to her own negligence. We removed the e-mail addresses because the people fear retribution by animal hoarder Kimi Peck. Lt. Speirs admitted animal hoarder Kimi Peck was not only negligent – she also had over 350 animals when they raided her facility. KIMI PECK IS NOT AND HAS NOT BEEN IN BURBANK SINCE 2005!

Permit me to provide you the facts as they pertain to your questions: 1. The Burbank Animal Shelter submitted 11 criminal violations for filing consideration in May of 2005 – three months ago. A plea agreement (which we are not part of) was reached and she plead out, agreed to cease her operations, and reduce the numbers of animals she had until they were all gone. She was held accountable in a court of law. 2. We can not deny her right to own an animal and I don’t think any court in the land can take that right away from her. 3. Yes I am aware that Ms. Peck was not in court as I was there. Ms. Peck was represented by her attorney which is her constitutional right. 4. She is down to 98 animals from the high of 350 that she had on the facility in May. They were adopted out or given to other rescues. 5. The Burbank Animal Shelter is the agency that took the action – we care. 6. I estimate that within 3 weeks she will be totally out of business and all the animals gone.

Serial Animal Hoarder Kimi Peck Conspiracy Theory

Who will be Serial Animal Hoarder Kimi Peck’s next victim until she’s shut down for good????? If she is living in your neighborhood – it will be you…be careful…she’s an animal hoarder…Read the quotes from News Outlets – Kimi is not famous – she’s an infamous serial animal hoarder and that’s the only reason she’s in the spotlight

Since 1997, Kimi Peck claims there’s been a conspiracy following her. The people conspiring to ‘get’ Peck? Here’s just some of the many she blames: Burbank Animal Control, Burbank City Attorney, former Burbank volunteers including Robyn Berkenfeld (Peck has blamed Robyn Berkenfeld for everything), former landlords, Susan Marlowe’s ex-husband, Peck’s Tehachapi neighbors, Julie Sugg, Kern County Animal Control, Don Maben, Chuck Lackey. Peck a victim or a nutcase? You decide? Read some of the quotes to media outlets over the years made by Kimi Peck regarding the people out to ‘get’ her: ***September 2003, LETTER TO BURBANK OFFICIALS: Burbank County convicted Peck of operating illegal kennels and unsanitary conditions, among many other convictions. Instead of cleaning up, Peck had her then attorney demand with threats that Kern County stop harassing Kimi Peck. Here’s a quote from the letter (though Burbank, as everybody knows, legally forced Peck out in 2005 and Peck is now on Los Angeles Do Not Adopt to list): March 2003: "I am demanding that this harassment end and that the City work with us to make Chihuahua Rescue the best facility possible for the rescue and rehabilitation of dogs." Shannon Keith in 2003 (TWO YEARS LATER – PECK WAS LEGALLY FORCED OUT OF BURBANK DUE TO HER OWN NEGLIGENCE) ***May 2005, LA TIMES: Peck claims she’s the victim of a smear campaign launched by a homeless former volunteer who’s angry that Peck wouldn’t let her sleep at the shelter. She said she’s going to relocate the shelter — possibly to Northern California or Arizona, and file a lawsuit. January 2007: Burbank Leader – two articles – first one called in by Kimi Peck herself bragging about a lawsuit she filed against ten former volunteers – a lawsuit that was dismissed before all defendants were even served – why was it dismissed? Kimi Peck’s own attorney investigated Peck’s hoarding history and realized she’s dealing with a nutcase: ‘Shelter files suit against volunteers Director of Chihuahua Rescue opens an action claiming slander and defamation against 10 former unpaid workers. February 21, 2007|By Chris Wiebe BURBANK — The director of a Chihuahua rescue shelter, which operated out of Burbank for more than four years, has filed a 10-party lawsuit against some of her former volunteers, accusing them of a smear campaign that tarnished her business reputation. Kimi Peck, director of Chihuahua Rescue — which relocated to Tehachapi after a court order forced the shelter out of Burbank — contends in her lawsuit that former volunteers committed slander and defamation against her when they told police in 2005 that Peck kept Chihuahuas in unsafe and squalid conditions. The volunteers also alleged that Peck was hoarding dogs rather than finding them new homes. After Burbank Police and animal control officials investigated, Peck was charged with having insufficient food and water for her animals, failing to maintain sanitary and safe conditions and keeping insufficient records for her animals. She pleaded no contest to the latter charge in June 2005 and the other two were set aside. B y October 2005, she had cleared out of her Burbank facility, moving to Tehachapi, where she says her rescue operation has suffered as a result of the complaints of the volunteers. "It’s been very painful, very hard," she said "And I can handle everything, but it has affected the dogs, and that hurts me." But attorney Larry Rudd, who represents the 10 defendants named in the suit, said that Peck has no evidence of defamation and slander and that the law protects the rights of people to make critical statements to authorities about bad business practices. "This is an attempt to harass people who only sought the best interest of the animals," he said. "These are people who left because of despicable conditions." Volunteers reported seeing dogs that were seldom released from their cages, living in their own feces, he said. A veterinarian who leased a space next door to Chihuahua Rescue on Moss Street terminated his portion of the lease, saying he could no longer carry on his practice so near to the shelter’s conditions, Rudd added. "Kimi Peck, in keeping with her prior actions, files suits against anyone who disagrees with her, anyone who comments about her poor care and treatment of animals," he said. Rudd is filing a motion disputing Peck’s complaint as a Strategic Lawsuit Against Public Participation suit, which is a litigation strategy intended to stifle or intimidate the critics of the plaintiff. He will also pursue Peck for his attorney’s fees and may pursue her attorney on grounds of malicious prosecution. "This is just an absurd suit and it should never have been brought," he said. Peck grabbed headlines in 2003, when she saved 170 Chihuahuas from being euthanized after Los Angeles County animal control officials confiscated the dogs from breeder Emma Harter. Harter was subsequently convicted of animal abuse for housing 235 Chihuahuas in fetid, unsanitary conditions. But two years later, Peck found herself the target of accusations from volunteers at her own shelter, which ultimately drove her from Burbank. ****NEXT ARTICLE IN SAME PAPER WHEN HER ATTORNEY DISMISSES CASE…CHECK OUT DATE: Briefly In The News February 24, 2007 Activist dismisses defamation suit The attorney representing an animal-rights activist who once ran a rescue shelter in Burbank dropped her 10-party defamation lawsuit in Los Angeles Superior Court on Thursday. The lawsuit brought by Kimi Peck, director of Chihuahua Rescue — which she relocated to Tehachapi after a court order forced her to close the Burbank shelter — alleged that some of her former volunteers had launched a smear campaign that has damaged her business reputation. Attorney Larry Rudd, who represented the 10 defendants named in the suit, said that he turned away attempts from Peck’s attorney, Theresa Macellaro, to negotiate a settlement and then learned shortly thereafter that the case had been dropped. "This was just another attempt to harass people by Kimi Peck," Rudd said. "I don’t know what her next step will be, but my guess is that she will be trying to find another way to file a suit or do something — because this is just a person who does not take no for an answer and just tries to abuse the system." Peck grabbed headlines in 2003 when she saved 170 Chihuahuas from being euthanized after Los Angeles County animal control officials confiscated the dogs from breeder Emma Harter. Harter was subsequently convicted of animal abuse for housing 235 Chihuahuas in unsanitary conditions. BEWARE OF DAVID MABRA – ACTIVE CHIHUAHUA RESCUE/DOG ANGELS BOARD MEMBER

http://www.pet-abuse.com/profiles/5376 David Mabra continues to stand by his ‘friend’, Kimi Peck. Following is what he said in 2005, after she was legally, YES LEGALLY, forced out of Burbank. Mabra has to be aware that Chihuahua Rescue has raised well over $1,000,000.00 in donations, much of these donations were used to pay for illegal kennels and Kimi Peck’s personal expenses. Much of these donations were collected using deceptive advertising. David Mabra is a board member for Chihuahua Rescue aka the Dog Angels, he opens himself up to public scrutiney and many wonder how a man who claims to have dignity, would continue to sit on a board of ‘rescues’ run by a woman with a history of animal related neglect. Following is what David Mabra said in 2005 after Peck was legally forced out of Burbank. The comment was posted on one of the many websites the Chihuahua Rescue ‘group’ has created over the years to slander anybody who questioned serial animal hoarder Kimi Peck’s unethical treatment of animals and monies. Since he wrote this letter, Kimi Peck was legally forced to shut down two more illegal kennels, was arrested, harassed and stalked her Tehachapi neighbors and was forced to give up close to 200 animals to the HSUS…

From 2005: My name is David Mabra. I have been a friend of Kimi Pecks for 10 years and have assisted her in her rescue efforts for the last 9 years. I have been with her through the "thick and thin" of a rescuers life. It is a thankless life that VERY FEW people in the world would even attempt to live through. Everyone is a critic and it seems that everyone has a "better" way to save dogs. However, VERY FEW people have saved as many dogs as Ms. Peck and raised such awareness to the plight of dogs (and cats and other animals) as Ms. Peck. I can’t tell you how many hundreds of "home deliveries" I have been on with Kimi because she insists on making sure the dogs end up in the BEST possible enviornment. NINETY percent of the animals we have saved were "throw-aways" (old, sick, dying, or about to be euthanized to "make space" for other unwanted animals). I personally cleaned and fed these dogs and rushed them to the vets as needed. I witnessed Kimi spend EVERY cent she had and when she would run out of money she made the impossible happen and "pulled rabbits out of hats" to get dogs medical attention when needed. She also spent her own money to have dogs spayed and/or neutered to assure that there would be NO more unwanted offsprings. Her efforts at spay and neutering have saved our communities thousands of dollars in animal control. There are hundreds of testimonies from people who have adopted dogs that Kimi has saved and love her for saving their new "FAMILY MEMBERS". I was with Kimi at every location she was forced to move to on her trek to the current "beautiful" kennel in Burbank. There were times along the way that Kimi sacrificed her own dignity and welfare for the sake of the dogs. NO dog EVER went without food or water but I know for a fact there were times when Kimi went without the means to support herself at the expense of helping the dogs. It is true she struggled financially at times and wasn’t able to maintain the "idyllic" conditions that she wanted for the dogs, however, NO dog EVER suffered from neglect while in her care. Again, everyone thinks they have a "better" way (like euthansia – most of the dogs didn’t think that was BETTER!) and everyone is entitled to their "opinion" – including Kimi Peck. Three of the landlords along the way believed in euthansia because, in my opinion, they didn’t want to take time or money from their shallow lives to take care of those less fortunate. NONE of the landlords we had to deal with could even conceive of "GIVING UP THEIR LIFESTYLE" to save dogs. No one I have met before or since has the kind of compassion and comittment that Kimi Peck has. Kimi is not perfect, and she has had more than her share of trouble in her struggle to save dogs, but she has NEVER faltered or given up because some people didn’t agree with the way she did things. Even Jesus had people who thought his way was the wrong way. My hope is that everyone who reads the vile things being posted about Kimi Peck know that those things are meant to hurt Kimi – not help the dogs. The dogs in Kimi Pecks care are in a wonderful situation that has been APPROVED BY BURBANK ANIMAL CONTROL to stay in operation until she has been able to relocate to a bigger facility AT HER OWN REQUEST. I am posting my personal email address if anyone should question the authenticity of this posting. Also, if ANYONE uses my name in a "slanderous and/or libelous" internet posting I WILL take IMMEDIATE court action against such person(s). As the "so-called" lawyer for this group knows, Kimi Peck, as a celebrity is an easier target than an average citizen like myself. Sincerely, David Mabra

Kimi Peck and Delta Burke?

We have to feel bad for the innocent people who Kimi Peck is now dragging into her animal hoarding lifestyle. She dug up another 10-year-old picture she found when Delta Burke was helping her promote Chihuahua Rescue before Peck was given official title of ‘ANIMAL HOARDER’. Does Delta Burke know Kimi Peck’s criminal history including the fact she was ARRESTED in 2010! SO CAL DNA/DNR ALERT

**SO CAL DNA/DNR ALERT** KIMI PECK, of disgusting chihuahua hoarding fame is back on the rescue scene with a new FB page called "Chihuahua Rescue Beverly Hills". PLEASE DO NOT give this woman dogs, pull for her, fake adopt for her, etc. …DO NOT help her obtain any more pups. Simple Google check turns up all you need to know about Ms Peck’s "rescue" standards and practices. Please ‘flag/report’ her FB page and PM Angels for Animals Network immediately if you see her on any of our threads so we can ban her. Thank you and please help keep animals out of dangerous irresponsible hands. xx

Kimi Peck and Alison Sweeney?

One of the pictures Kimi Peck has decided to use to promote herself as a ‘rescuer’, again, with Allison Sweeney was taken ten years ago – since this picture was taken, Peck has been legally forced out of Burbank and Kern County due to animal related neglect. We highly doubt that Alison Sweeney would be promoting Kimi Peck now. Kimi Peck is NOT an animal rescuer. She is an animal hoarder.

The Extremely Insane Animal Hoarder, KIMI PECK

We decided to re-post a blog written by Bakersfield.com’s, James Burger, back in January of 2010. Kimi Peck is not only an animal hoarder, she’s also, as we have stated over and over again, CRAZY. This blog will confirm that Kimi Peck is CRAZY. She’s always blaming somebody for her hoarding addiction. Here she blames retired County Supervisor, Don Maben

posted by Jburger on Jan 5, 2010 at 02:38 PM The hearing on Peck has begun. Engineering and Survey Services Director Chuck Lackey is making his report to the board. "We have determined that the keeping of approximately 170 dogs is not incidental to the use of the residential site," Lackey said. That means, basically, that the dogs aren’t there because Peck lives there but Peck lives there so she can keep the dogs there. That, Lackey said, is a violation of county ordinances. "She was informed that she could not keep the animals on the property unless she got a conditional use permit," Lackey said. Report Violation posted by Jburger on Jan 5, 2010 at 02:43 PM Peck told the county this morning that she removed around 40 dogs At the previous hearing Peck argued that the pets are her personal property, Lackey said, and that she is keeping old, injured and unwanted animals to live out their lives. That is, Lackey said, the definition of an animal shelter according to county law. "The housing of the animals has become the primary use of the property," Lackey said. To maintain a shelter on the property, Lackey said, Peck has to have a conditional use permit. But she has refused to apply for one. Even if the license issue is resolved that does not resolve the land use problems on the property, Lackey said. Report Violation posted by Jburger on Jan 5, 2010 at 02:58 PM Peck is arguing that county ordinances "Stop this witch hunt. Don’t make me sue you. Stop these fines now," Peck said. "How much did Michael Goland pay you." (Michael Goland is Susan Marlowe’s ex-husband and Peck has repeatedly accused county officials of being paid off by Goland to harass her.) Pecks calling the board corrupt and "unbelieveably cruel." "Just try and fine me," she dared supervisors. "try." Property owner Susan Marlowe up to speak. She said the ordinance allows the breeding and raising of animals is allowed on the property. Note: Peck said in the hearing that the animals are old and unlovely and are just on the property to live out their lives. Report Violation posted by Jburger on Jan 5, 2010 at 03:01 PM Marlowe said she has eviction proceedings started against Peck. Janet Wingfield, Kimi Peck’s supporter, is speaking. "I think she has been chased down like a rabid dog," Wingfield said. Report Violation posted by Jburger on Jan 5, 2010 at 03:07 PM "There is conspiracy against Ms. Peck," Wingfield said. Wingfield is accusing the county of conspiring with people who destroyed a water tank on Peck’s Water Canyon Road property. She’s accusing county animal control officers of falsifying court documents to try and get Kimi Peck. She and Peck both acused Supervisor Don Maben of vowing to get Kimi Peck in any way possible. Report Violation posted by Jburger on Jan 5, 2010 at 03:14 PM It’s back to staff. Ted James is speaking. He said Marlowe’s comments about animal breeding is in ordinances Before Peck left the Water Canyon Road property, James said, he and Lackey made it very clear that zone "She acknowledged that she needed to get a conditional use permit," James said. "There is no witch hunt. There is no sidestepping." Lackey said Peck is arguing that animal control regulations allow her to choose between licensing her dogs and getting a conditional use permit. But the county is arguing that she is violating land use laws — not animal control laws. They brought action against Peck, Lackey said, because "It appeared that Ms. Peck was ignoring our requirements to comply." "She moved to another piece of property and we started all over again," he said. He said they want Peck to keep the animals. But they also want her to comply with county zoning laws. Report Violation posted by Jburger on Jan 5, 2010 at 03:26 PM "We wouldn’t be here today if you had listened to staff and applied for a conditional use permit," Maben told Peck. "You picked a good location to move your dogs to." He called for a $5,000 fine against both Peck and Marlowe and an ongoing $500 fine against both – but freeze the penalty for 30 days to give Peck a chance to apply for a conditional use permit. "Why would I get a permit on a house I don’t own," Peck shouted from the audience. She said the house she lives in was sold at auction Tuesday morning. But Maben said he does not have that fact in evidence and can’t rely on it to make a decision today. County lawyer Bruce Divelbiss recommended that the supervisors might push back action on the issue until more information is produced. Peck just about got removed from the building by the Sheriff’s deputy in the back because she talked over supervisors and refused to leave the podium. There should be due notice for any buyer of the property, Lackey said. Supervisors delayed the issue until Feb. 9.
